- (referred to as either "the Company", "We", "Us", or "Our" in this Agreement) refers to Enterprise Software Development LLC, Florida, United States of America.
- CCPA/CPRA
- refers to the California Consumer Privacy Act (the "CCPA") as amended by the California Privacy Rights Act of 2020 (the "CPRA").
- Consumer
- for the purpose of the CCPA/CPRA, means a natural person who is a California resident.
- Country
- refers to: United States of America.
- Device
- means any device that can access the Service, such as a computer, a cellphone, or a digital tablet.
- LLM Data
- refers to the information generated, collected, or processed as a result of queries, prompts, responses, and outputs of third-party language models (such as OpenAI, Anthropic, Google, Perplexity, among others) used by the Application to provide the GEO Service.
- Personal Data
- is any information that relates to an identified or identifiable individual.
- Service
- refers to the Application.
- Service Provider
- means any natural or legal person who processes the data on behalf of the Company. This refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used. This includes, without limitation, LLM API providers, generative SERP scraping and analysis services, and data processing services.
- Usage Data
- refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit, queries made to LLMs, or the number of brands monitored).
- You
- means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Personal Data
While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

GEO Platform-Specific Data
Due to the nature of Our Service as a Generative Engine Optimization (GEO) platform, We also collect and process the following types of data:
- Brand and Domain Data: URLs, domains, brand names, products, competitors, and keywords that You enter or configure for monitoring within LLMs and generative search engines.
- Prompts and Queries: the queries, prompts, and questions You define or that the platform generates automatically to evaluate the visibility of Your brand in LLMs.
- LLM Outputs: the responses, citations, mentions, and content returned by third-party language models in connection with Your queries. Please note that these outputs may be processed by external providers (e.g., OpenAI, Anthropic, Google) subject to their own privacy policies.
- Uploaded Content: any content, document, file, or information You voluntarily upload to the platform for analysis or optimization purposes.
- Configuration Data: preferences, integrations, connections to third-party tools (e.g., Google Search Console, CMS, analytics platforms), and API credentials You choose to connect to the Service.
Usage Data
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol (IP) address, browser type, browser version, the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers, the number and frequency of queries made to LLMs, brands and domains monitored, and other diagnostic data.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain Our Service: including monitoring the usage of Our Service and executing LLM queries on Your behalf.
- To manage Your Account: to manage Your registration as a user of the Service.
- For the performance of a contract: the development, compliance, and undertaking of the subscription agreement for the GEO services You have contracted.
- To train and improve Our proprietary analytical models: We may use aggregated and anonymized data derived from the use of the Service (queries, LLM outputs, visibility metrics) to improve the accuracy, coverage, and quality of Our GEO Service. We never use identifiable proprietary or confidential content for this purpose without Your explicit consent.
- To contact You: by email, telephone calls, SMS, or other equivalent forms of electronic communication.
- To provide You with news, special offers, and general information: about other goods, services, and events which We offer that are similar to those You have already purchased or inquired about.
- To manage Your requests: to attend to and manage Your requests to Us.
- For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets.
- For other purposes: We may use Your information for data analysis, identifying usage trends, determining the effectiveness of Our promotional campaigns, and to evaluate and improve Our Service, products, services, marketing, and Your experience.

Please note that the queries and prompts You execute through Our Service may be transmitted to these LLM providers and processed according to their respective privacy policies and terms of use.
- For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition.
- With Affiliates: We may share Your information with Our affiliates, in which case We will require those affiliates to honor this Privacy Policy.
- With business partners: We may share Your information with Our business partners to offer You certain products, services, or promotions.
- With Your consent: We may disclose Your personal information for any other purpose with Your consent.
Processing of Data by Third-Party Language Models
Our GEO platform operates by sending queries and prompts to large language models (LLMs) operated by third parties, including but not limited to OpenAI (ChatGPT), Anthropic (Claude), Google (Gemini), Perplexity, xAI (Grok), and others. By using Our Service, You acknowledge and agree that:
- The queries, prompts, and content You input may be sent to these LLM providers as part of the Service.
- The processing of this data by LLM providers is subject to their respective privacy policies and terms of service.
- We make reasonable efforts to use enterprise or "no-training" API options when available, in order to prevent Your content from being used to train third-party models.
- We do not control how these third parties process, store, or retain the data sent to them, and We recommend reviewing their privacy policies.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations, resolve disputes, and enforce Our legal agreements and policies.
Usage Data, LLM query history, and monitoring results will generally be retained for the duration of Your active subscription plus a reasonable additional period for backup, audit, and analysis purposes. Aggregated and anonymized data may be retained indefinitely.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company's operating offices in the United States and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of Your jurisdiction.
If You reside in the European Economic Area (EEA), the United Kingdom, or Switzerland, Your data may be transferred to the United States. The Company will implement appropriate safeguards, such as Standard Contractual Clauses approved by the European Commission, to protect such transfers.

Payments
